Hi,
I am Vijay Vellabati, finished MS in Dec-06 and I got a job in Jul.
I am in my OPT(Optional Practical training). I did not get to file for my H1-B.
Can my company apply for Green card for me right now.
Because I need to keep my status, my OPT expires in Dec-07.
If anyone can get back to me, I would appreciate that.

Yes, green card is for future employment, your employer can apply for your greencard!!
But usually the greencard process takes so long that it is nearly impossible to get it in a year (the time you have in OPT) so the safe bet is to apply h1b otherwise in US-Masters quota if you have one. And take it from there.

Please help me, married a us citizen right after 3 months I have my green card in 08 we got into a fight and she divorced me 2 months later and finally decreee june 2008. we are back together and live in the same house hold and in feb 2010 when my green card expire and I need to file to remove the condition, I dont know what I or we need to do?? is this the better way is for us go down to court house and get married again? we still have banking account together and bill together>
Please let me know what is the best for my situation.

If you are considering working for Sharper Impressions painting... don't. THEY WILL RIP YOU OFF. They prey on those who don't have the money or the resources to fight them. My company filed for my GC in June'07. They goofed up and filed under EB-3 instead of EB-2. The company apologized and is ready to change my filing to EB-2. I am wondering whether this would be a good step? Following are my details.
- My PD is June07
- Labor is approved (in 1 week)
- I-140 approved
- My 6 yrs on H1 were completed in July09
- I have received 3 yr H1 ext
- Me & Spouse both have received EAD (I am not using my EAD card)
I am not tracking the progress of visa number availablilty, but I presume that EB-2 would anyday be better than EB-3.
Please advise whether chnaging to EB-2 would be a good idea?

When my wife went to get her H-4 stamped, I gave her my original I-797. I think the applicant need to carry the original I-797 document with them for the interview...

I filed for I751 (remove condition of my green card) on June 2007. Received by USCIS on June 07, 2007. I already received my extension and the biometric appointment.... still on Texas center. How long you think I have to wait until I get a response of approval??? they said (before they got behind) that it takes 6 months.... December will be 6 month.... who knows what is really happening on immigration??? what cases they are putting behind and what cases they are working on??? (I know that the time schedule says April 07, but in the last month they only process cases receive on 4 days, last month said April 3 and this month April 7)
The thing is that I want to change my Job, but who will ever hire me with only a 1 year extension green card!!! help please!

My current H1 expires on Sept 30. My employer is planning to apply for an extension in the first week of April. Can they file my LCA in advance so that they can have an approved LCA by the first week of April? Or, do they have to wait till Apr 1st (6 months before current H1 expiration) to file for the LCA ? I was not able to find information about this specific scenario.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. My mother has Family based green card, which she got last year. Since then she has been out of the country once and came back on 1st march 2010. My mom wants to go back to india for an year or so, to take care of some matters.....
how do we go on for filing her extension or parole or whataver its called...so that she can stay in India for maximum time and doesnt loose her GC ?

Hi,
I received an RFE for proof of maintaining legal US residence in the form of I-797 forms of H1b extension or EADs etc. What was surprising is that we had not filed a medical exam with the original 485 application as we couldnt get an appointment in time before the retrogression and thus have been waiting for an RFE for the same. Yet they have not asked for it.
Can we (in addition to providing the required docs for the RFE), send the medical exam sealed envelope (obtained later but within the past year) even though it wasnt requested yet? The USCIS provided envelope is of course too small to put everything into but we plan to attach it to the couriered docs. Does this sound reasonable?

its mostly additional security review. A friend of mine was in similar situation, took about 6-8 weeks for him to get a visa.... but unfortunately client wasn't ready to wait that longer.....

My online case status changed to the following information "On April 22, 2010, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283". I am applying for my family and I but my 3 year old sons update is RFE??? I havent received the letter yet but I was wondering if anyone else found themselves in this situation and if so what was the outcome?
