    Hi I heard there are 2 catagories in L1. Managerial /executive and the other one is highly skilled. Where you in the first catagory which does not require the labor certification? or did you have to get the LC?

    AS my PD is current july2003 EB2 and i have my AP documents.. can i travel to india for 1 month ??? as in case my I-485 is approved when i am in india what will happen to my status?
    what all documents do i need to take when i go to india? Please help me

    South Carolina Republican Senator Lindsey Graham has said many times in the past that the GOP needs to move back to the middle on immigration reform.     You should be able to work use EAD...your husband can still work on H1. First u need to apply for SSN to work.

    Hi !
    My husband is on H1 and i am on H4. We recently got our EADs. What I want to know is, can i start working right away with my EAD while my husband works on H1 or are there any rules like my husband also needs should change his status from H1 to EAD so that I may use my EAD card?

    This was quoted on Numbers USA site -
    Sen. Robert Menendez (D-N.J.) is still holding hostage E-Verify reauthorization legislation in the Senate until he gets 500,000 additional permanent foreign worker visas. These are simple "skilled" visas, where an individual doesn't need any specialized training or education (other than two years of college). As such, the legislation would keep a half-million Americans out of work. Senate leadership is considering taking up the E-Verify reauthorization bill today before members depart for summer recess, so Senators are negotiating with Menendez in order to reach an accommodation.

    I think if you are out of the country for 1 year u can get 3 yr extension. But you would get counted in the quota though,fresh H1, I think.

    Below is my situation;

    Last project ended July 17 and am out of project since then and my last pay check was for the week of July 17. I was sent a termination letter and my employer said that he will not revoke my H1B and told me to transfer my H1B ASAP. I have been trying to do a H transfer from then on but no company is willing to do since I don't have a project and every one told to find a project first.

    Finally I found a project but now employers are not willing to do a transfer saying that I don't have pay stubs for almost two and half months. A few employers are suggesting to file a new H1B.

    What would be the best course of actions in my situation.

    Hello All,
    I am on H1 Right now and through the same employer i filed my GC in May 2007 (I-140 approved in Oct' 2007)
    but I have got an offer from another company who is willing to transfer my H1, so wanted to know what is the best options.

    - Should i Switch on H1 and if yes, can i start working for them before the H1 Transfer process is complete
    - If I did decide to go on H1 then do i need to file some documents for my I-485 and EAD Renewal as well (meaning do i have to inform USCIS about my change in employer for GC application)

    HI,

    I had my 1st H1B with a non exempt company for 1 yr then I joined a Exempt company (university) and they filed for my H1B. I am in my 8th yr of H1B with the university & recently got 3 yr H1B extension. If I want to change jobs to non exempt can I do the H1B transfer or do I have to apply a new H1B and will I be subjected to the quota restrictions.

    Since I originally had H1B which was counted against a quota, couldn't the new non exempt company just transfer my H1B.

    Any information is greatly appreciated.

    I am on L1B visa from Apr 2008. I have my PERM and I140 approved.
    I got a email from my attorney stating that they want to file my H1B petition this year so that they can keep on renewing my H1b as long as my company wants.

    Suppose they file H1B COS petition then my status will automatically change on Oct 1 2010.

    I am planning a vacation to India in November 2010, what are the options with me when come back to US.

    - Do i have to stamp the H1B visa OR

    - I can still come back on my existing L1B visa ???


    Please suggest

    Hi My wife's H4b status is valid till 6th sept. Now she has her h1b approved on 3rd july. Her employer states that the approved petition has some clause that she has to leave the country and come back with h1 on nov 1st. Both the employer and myself are not comfortable doing that.

    Her employer suggesting for h1b renewal under premium process so that i might get receipt in few weeks and also says that he would reapply for H1 wiht the receipt for the approval.

    Please suggest me the best possible way ...
