My I-94 extension (for L1B visa) was denied on Oct '08 and I returned in 4 days after they updated Denial status. Reason for denail is "lack of specialized knowledge". I am planning to apply for L1B again in next month (By showing additional certification). Can you please advice me

- is it fine to apply for visa again as it will be more then 6 months after it was denied

- Do I need to show the copy of denial notice during visa interview? Is there any thread available providing suggestions for those applying for visa again after it was denied earlier...

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.

I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

My company changed address while my transfer H1b petition was pending. We moved just across the street from the original location and thus the company did not call USCIS to notify them of the address change because we still had access to our old mail box. Unfortuanately my approval notice was returned back as undeliverable and I received an email to that regard.

The secretary from office called USCIS and had the address changed immediately, its already been a month but we still haven't received the approval notice at the new address...has any one else here has similar experience...how long do you think we should wait before we call the USCIS again ?

My husband has 7 words in his name on passport. When we went for Driving licence they took a part of that whole name and issued the licence. But even the last name and first are totally changed now.
How can we change his long name to short by taking only two words from 7. Does it come under Name change case or any other procedure.
Please let me know.

Hi Gurus

My I-140 petition was denied 2 months back and My attorney is trying to re apply for it. In the mean while there is a query on the company it self and our attorney is working hard to get it cleared.

In the mean while I am thinking about switch the employer.

I am in 8 th year extension and My VIsa is valid until jan 2008.

1.Assuming some comany offered me to apply for I140 and 485 and join that the company, what will happen If I140 has not been cleared before Jan 2008?.

2.What are the pros and cons I should think about when I switch the company.?

My wife is planning to travel overseas for 3 months and return on AP. Her status is AoS(dependent) as she quit working on H1 a few months ago. Any experience using AP for such long stays outside the country? Please share your experiences.

One of my friend who is an accountant's H1 visa was sponsopred by a non-accounting firm who needed an accountant who is familiar with accounting pratices here is USA and India. Now that the firm who initially hired him and sponsored his visa doesn't have a full time accountant requirement and he is finding it difficult to find an accounting firm to sponsor his visa. But the firm who originally hired him is willing and has an opening to place him in an accounting firm as accountant. But since the firm who originally hired him is not an accounting firm is there any legal issue in doing so. If it is legal, what should the either of the firms and/or he should do as far as paperworks are concerned.

I had applied EAD back in 2009.
I received my EAD which was valid from 06/02/2009 to 06/01/2010.
I had applied 485 back in August 6,2007.

So here are the questions:
1) Some of the instruction says, we should not pay for EAD application if we applied on or after 30 July 2007 though I applied in 2009 with application fee of $375.
Should I get back the above filling?

2) Why the EAD was issued for 1 year instead of 2 years for the first time?

3) If I apply now should I file with application fee? Because some instruction says that I donot have to send filing fee as this is a renewal.

4) Can I file electronically?

5) Should I file for EAD to Nebraska office where I filed 485 back in 2007?

I had applied on July 19th to Nebraska. My I-140 was approved from TX.
Today I received transfer notice WAC...., mentioning that they have transferred my case to TX Service center.

The receipt date is of Sep 14th, Notice date of Sep 17th'2007.

Does it mean I lost the original filing receipt date of July 20th'2007.
