Hi

I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.

Is this correct? Or is the lawyer being overly cautious?

If such a rule does exist can you please point me to the exact regulation?

Hi Guru's,

I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:
Back Ground:

1. My husband and myself are applying for H1 B.
2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.

Q & A:

1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.

Your valuable suggestions are greatly appreciated.

Any way to expedite Indian Passport renewal in India. My wife applied the passport renewal in Chennai in Feb 2011. It is almost 3 months. Usually how long it will take ?. Is there a way to contact them to expedite the process.

I applied Tatkal passport renewal for my son in April 2011. It is a month now. Not received.

There is no enough information on whom to contact and how to expedite the service.:(

Opponents of Arizona's SB1070 immigration law scored another victory in the courts yesterday. In the case of Friendly House v. Whiting, the court overruled a motion to dismiss the case challenging the law. The judge noted that "Racial discrimination was a motivating factor for [S.B.] 1070�s enactment" which establishes a legitimate constitutional challenge to the law. The "A" number eventually becomes your GC number. It is not necessarily the Visa Number...we don't get to see the Visa Number.
