Hello Everyone,
I need some suggestions from you guys.
My Employer A filed my green card labor in April 2000.
I was working with them on H1B till May 2003.
I moved to Employer B on H1B in May 2003.
Employer A continued to process my GC, and they filed my I485 in Jan 2007. I paid for the expenses.
My I485 is now pending at TSC.
Also Employer A confirmed they will support till i get my GC and I don�t have to work for them.
Can I use AC21 portability to move to another employer C using my EAD?
Do you see any issues i may face since i am not working for employer A?

I posted this in the Non-immigrant visa section, but I'd also like to get a professional opinion. Sorry for the double post.
I have a rather simple question to ask. I came to the US on a J2 visa with my wife who entered a Ph.D. program. Last year I was accepted into the same program, starting this fall. I didn't change my J2 to J1 because I was waiting for a TAship job offer that would grant me a fee waiver.
Now we're back in the States and there is an on-campus job opportunity that would grant me a fee waiver. I am considering either a) staying on J2 but getting a work permit or b) changing my status to J1.
What I'd like to know is, can I sign a contract with an on-campus employer and start working while my J1 change is being processed? It doesn't really matter much if this means that my paychecks will be delayed; like I said, I would welcome the opportunity to get the fee waiver.

My husband and I are in a big Dilemma whether to apply for EAD or AP? In the lawyer's note,it says that anyone who is I-140 Beneficiary will not be able to use EAD and AP. Is it true?
We are on our 3 years H1/H4 using I-140 benefits only. What should we do?
Please guide us.
We still have 3 years remaining. Problem - We both have no visa stamping after we got our extentions which why AP is required at this point?
Are there any travel restrictions after we file I-1485 with AP or WITHOUT AP.
Please highlight. Will be very useful for us.

Hi mkrao, I received an email from CRIS today stating that my I-140 and I-485 is transferred to Washington, DC local office as well. Have you received any update on your case?

From Matthew Oh's website, sounds like labor sub will be history from next week.
What are people's guesses on how many of the BEC labor certifications will be rendered effectively useless because of this?
Also, does this mean it will be more straightforward to port PD after I140 approval (because the old employer has no benefit to revoking I140 anymore?)?

My uncle just received his L1 extension receipt. Lawyer was late in filing the L1 extension, but supposedly got everything ready and mailed it 2 days before the L1 expiration date.
However, my uncle received recepit for L1 extension, and received date is 2 weeks after the expiration of original L1. Please note I am talking about RECEIVED DATE (not Notice date or receipt date).
Does this mean extension will automatically get rejected based on late filing? Is there any recourse to this?
More importantly, Is my uncle Out of Status now? (He doesn't have anything else going besides L1)
Please let me know as soon as possible.

Hi,
My H1B transfer from Company A to B is denied on 04/22/2010 and currently I am working for Company B. Company B is planning to apply for MTR. Now I am getting offer from Company C. My questions are:
1) Is it possible to get H1B transfer on premium processing approved from Company C with EOS (Extension of Status)? Do I need to apply for transfer or New H1B with Company C?
2) Can MTR affect the new H1B transfer to Company C?
Will appreciate your quick response and thanks a lot for your great help.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

I can't help but notice that about 1/4 of recently processed audit cases were denied. As it goes now, I'll have to wait about another 6 month for a 75% chance to pass. Well for where the economy is headed right now it all probably won't matter anymore in 6 months.
