Hello,
I'm on OPT since Feb 14 2011. This is my first 12 months of the OPT. I recieved an OPT card from USCIS but I'm not sure what is my valid I-20 at this moment ? Is it the one saying that "OPT is requested" ? I filed a bunch of papers during OPT application but whatever reason my International officer never wants to explain anything to us students and I've to search everything on the internet. I'm applying for a driver's license test and want to know what I-20 would be needed.
Also, my employer is willing to file my H1-B. Should I tell him to file it this year or the next year ? They also signed up for everify recently.
Please suggest.

My spouse is out of country and she cannot comeback immediately since we are waiting for my H1 extension approval. Taking visa appointment days and airline availability in to consideration, she may not be able to make it back before end of july. I heard you can always add spouse later while 485 is still in progress. What are the implications if I go this path ?

My husband details:

We both have separate EADs and H1B visas and are independent of each other currently.
Because my priority date is 2006 and my husband's is in 2005, there is more possibility that he may get GC before my PD becomes current.
When my husband's priority date becomes current, he wants to file it for me again so i would get GC along with him.
I am now considering to look out for jobs and use my EAD card with new employer.
Can I make my EAD active ? Will it cause any problems when my husband's priority date becomes current and when we file my application along with his ?
Any input is greatly appreciated.

My employer says that he is going to run the taxes from the state where the company is located and not from the state where I'm actually working.
Says something changed on the company's front and the CPA advised that there won't be any problem .He's giving me all kinds of reasons about how he can't run the taxes from my state and says there won't be any problem in 485 stage.
If called for the 485 interview we may have to bring our pay stubs to the interview .In that case would there be any problem with this scenario.?
By the way the address I have on file for all my applications is another state (different from where I'm living and where my company is located).(If) called for an interview I guess it will be in the state which is on my applications . Does any one know if I'm right?

United States Citizenship and Immigration Services (USCIS) released an updated H-1B cap count of 45,100 as of August 28, 2009. This reflects an increase of 100 cases from the prior count, provided on August 14, 2009. The advanced-degree cap remains at 20,000. The USCIS continues to accept FY2010 H1B cases under the advanced-degree and regular caps.
We suggest to US employers to file H-1B Petitions only if they can able to provide the Client details like Letter from the end-client, Work-orders confirming the placement. If you are having an in-house requirement, provide USCIS with ample proof of your in-house requirements. Considering the flood of H-1B RFEs, we have to be bit cautious in filing works. The standard approach prevailing until last year needs a re-look. Be assured, if you are right on papers and abide the Immigration requirement, you will for sure come with flying colors. We will be happy to help and support you in H-1B and other filings. It is widely believed that the H-1B Cap will be available even after Sept. 30, 2009.

FIRST GUN CONTROL, now fuel economy. Congressional Democrats still have a lot of work ahead to get their groundbreaking bills past both houses and the president's desk, but you can't say they're not leading a radical change in direction.
On June 13, the House passed what could become the first major gun-control law in a decade, a bill aimed at strengthening a federal database used in background checks for gun buyers. A week later, the Senate approved an energy bill that would improve mileage for the nation's automotive fleet for the first time in nearly 20 years. Democrats still haven't forced a troop reduction in Iraq or put their stamp on the nation's backward immigration policies, but their surprising success in other areas is worthy of praise.
Not that Democrats deserve all the credit. The gun bill was a bipartisan effort that passed by acclamation after it won the blessing of the National Rifle Assn., while 20 Republicans � nearly half the 43 who voted on the measure � backed the fuel economy bill. Still, these measures would have been inconceivable while Republicans controlled both houses during the first six years of the Bush administration, a period characterized by the disgraceful decision to allow a decade-old assault weapons ban to expire in 2004 and successive energy bills focused on maximizing fossil fuel production at the expense of the environment.
It would be nice to think that the broad Republican support for a progressive energy bill signaled a pro-environment change of heart. Unfortunately, it probably has more to do with the high price of oil; Republicans are feeling pressure to bring gas prices down. They also rightly see dependence on foreign oil as a national security issue. The fuel economy bill would increase the average mileage requirement for cars sold in the U.S. from 25 miles per gallon to 35 by 2020, expected to eventually save millions of barrels of oil a day.
Regardless of their motives, Republicans' support for the energy bill will increase pressure on President Bush to sign it, assuming it gets through the House. Bush favors better fuel economy but wants it to come at a slower pace, with loopholes to allow more gas guzzling by SUVs. The Senate energy bill has its own regrettable loophole: A strong mandate was watered down in committee, allowing federal regulators to cancel the improvements if they decide the tighter standards aren't "cost-effective." But senators beat back furious efforts by the auto industry to weaken the bill further.
There was one sour note to last week's passage of the energy bill: An amendment that would have required the nation to get 15% of its electricity from renewable sources was defeated. Senate leaders should revive it in the future.

Dear Gurus,
I have applied for my I-485 in July 2007. A false DV case was filed against me by my ex-wife in January 2008 which was dismissed with prejudice in the court. I have all certified copies from court.
Now I got I-485 first interview letter from USCIS which is scheduled in Detroit.
Can I attend by myself or do I need to attend with a lawyer?
Could you guys advice me..
