Dear forum members,

I have a question regarding transferring my H1b. My scenario is i am on my 7th year of my H1b and it is expiring on Oct 2007. My current employer will be filing an extension of 3 years based on my approved I-140 in the month of June 2007. If everything goes well i will get my three year extension(2007-2010) by Aug 2007.

Question is

1) If i get a new job opportunity after 3 year approval ( start date will be Oct 2007) can i transfer it to my new employer by aug or i have to wait till the start date of H1 approval?

2) When can i start working for the new company?

Any response will be appreciated.

Hi Experts,

My wife is on H4 visa and has started her MS in CS in Jan. She applied for her change of status to F1 visa on 15 th feb. As of today (17th March), her approval notice hasnt come and her H4 is expiring on 31st March. I am not even able to follow her case online on USCIS coz her return recipt number is not updated at all. This is quite common I have heard.

My question is, should we also apply for her H4 extension before 31st of this month so that in case her approval for F1 does not come before her H4 expires and in worst case it gets rejects, she still wont be out of status coz her H4 renewal application is in place or am i just being too paranoid and should just wait for her F1 to come??

Guys, I need ur suggestion and experiences on my typical situation

I am in the process of going full time with my client.

I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.

my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.

My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.

Was anybody in a similar situation ?

I don't want to take a risk by using EAD and my wife loosing H4 status.

Please advice

I am also in the same situation that my company's attorney is not giving me I140 receipt number. They just say that it was filed in first week May but don't have the receipt number yet.

If you have a phd, is it automatically EB1? or do the rules of employment should call for phd apply?

Remember the rule of thumb nothing is automatic when comes to immigration.

Hi ,

There is a job opening at client place and job opening title is "JAVA DEVELOPER/SR JAVA ENGINEER" and the responsibilities includes coding Java. I do not have approved Labor certification with me but my Labor application (Signed copy by me) say Job Title as "Programmer/Analyst" and responsibilities includes
"Analyze, design and develop applications using C++, Java, J2EE and Oracle."

Could you please let me know if I can work on EAD for the above job position at the
client place using AC21? I prefer not to talk with client if the labor and client job
requirements does not match.

I got my 140 approved and my 6 yr H1 gets over in Jan 2010.
Could someone tell me whn is the earliest I can apply for my 3 yr extension??
And is there a time period before you have to apply for the extension?
